Understanding your Rights Under Australian Consumer Law for Consumer Electronic Devices and Home Entertainment Products
The Australian Consumer Law protects consumers by giving them certain guaranteed rights when they buy goods and services. For example, the Law requires that goods must be free of defects and do what they are meant to do and services must be carried out with care and skill. These rights, which the Law says automatically apply whenever goods or services are supplied to a consumer, are called “Consumer Guarantees”.
This Law says that these rights cannot be excluded. You are entitled to a replacement or refund for a “major failure” if the goods fail to be of acceptable quality. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a “major failure”. Consumer Guarantees have no set time limit – depending upon the price and quality of goods, consumers may be entitled to a remedy after any manufacturer’s warranty or extended warranty has expired.

The following is the Agreement which applies to your use of web pages, software, networks and processes associated with the Website, including the purchase of Goods using the online purchase service operated by JB Hi-Fi Limited ("JB Hi-Fi, us or we"). By browsing through the Website, or opening an Account, you agree to the terms of this Agreement. Please note that the Agreement may be amended in the future and you should review it every time you access the Website.
1. INTERPRETATION
1.1 In these terms and conditions:
“Account” means the personalised account created by you on the Website enabling the Order of Goods.
“Agreement” means these terms and conditions, including the terms of any Order placed by you through the Website (if applicable).
“Goods” means any products described in an Order and includes packaging.
“Intellectual property” means all rights in patent, copyright, trade names, trade marks, logos, designs, images (including photographs, videos, multimedia or films) or service marks (in each case whether registered or registrable).
“Material” means any information (including but not limited to data, source codes, and drawings) or images in any form (whether visible or not) stored on or used in connection with the Website.
“Order” means a request submitted by you to purchase Goods from JB Hi-Fi through the Website.
“Restricted Material” means any product displayed for sale on the Website, the sale of which is restricted to persons of a certain age.
“Website” means the internet site located at www.jbhifionline.com.au operated by JB Hi-Fi.
1.2 Any reference in this Agreement to the singular includes the plural, to any gender includes all genders, to any act or statute includes any act or statute which supersedes, replaces or modifies any earlier act or statute, to persons includes all bodies and associations both corporate and incorporated and vice versa, paragraph headings are for reference purposes only and all references to clauses are to clauses in this Agreement unless otherwise specified. All references to dollar amounts are references to Australian dollars.
2. SPECIFIC WARNINGS
2.1 You must ensure that your access to, or use of, the Website is not illegal or prohibited by laws which apply to you.
2.2 You must take your own precautions to ensure that the process which you employ for accessing the Website does not expose you to risk of viruses, malicious computer code or other forms of interference which may damage your computer system. JB Hi-Fi takes no responsibility for any such damage which may arise in connection with your use of the Website.
3. LINKED WEB SITES
3.1 The Website may contain links to other web sites. Those links are provided for convenience only and may not remain current or be maintained. JB Hi-Fi will not be responsible for the content or privacy practices associated with linked web sites.
4. CUSTOMER ACCOUNT
4.1 You must create an Account before placing an Order for Goods through the Website.
4.2 You warrant that all information and data provided by you in the creation of your Account is accurate and up to date.
4.3 You must notify JB Hi-Fi immediately if you become aware of any unauthorised use of your password or of any other security breach relating to your Account.
5. GOODS
5.1 JB Hi-Fi takes no responsibility for the content of any Goods purchased through the Website.
5.2 You warrant that, if your Order includes Restricted Material, you are eligible to purchase such Goods.
6. PRICING
6.1 You agree to pay the delivery charges specified at the time you submit your Order.
6.2 JB Hi-Fi Online is currently offering free* freight to Australian addresses across all product groups.

7. ORDERS
7.1 You may place an Order by following the instructions on the Website. Your Order will be submitted by completing payment details and pressing the “Complete Order ” button. Orders will be deemed to have been received by JB Hi-Fi at the time JB Hi-Fi sends an Order confirmation to your nominated e-mail address.
7.2 Each Order (once accepted) represents a separate Agreement incorporating the terms of that Order.
7.3 JB Hi-Fi reserves the right to not accept Orders that request commercial quantities of Goods. If JB Hi-Fi is unable to supply your total Order this Agreement will apply to the supply of all or part of the Order.
7.4 JB Hi-Fi will use its best endeavours to supply Orders placed through the Website, however JB Hi-Fi reserves the right to cancel any Order without notice for any reason.
7.5 In event of a cancelled Order, any payments processed by JB Hi-Fi will be promptly refunded
7.6 Customers who wish to cancel an Order must notify JB Hi-Fi at order-cancel@jbhifionline.com.au by 9am on the next business day following the date of Order, quoting the Order reference number.
7.7 You acknowledge that the Internet can be an unstable and, sometimes, insecure marketplace. At times the Website may not be available, or Orders may not be processed or may not be accepted for reasons beyond our control. In these circumstances JB Hi-Fi accepts no responsibility.
8. PAYMENT
8.1 You may provide your nominated credit card details during the purchase process described on the Website.
8.2 Once the Goods are received from suppliers and are ready for dispatch or ready for collection, JB Hi-Fi will process payment for the Goods (plus any delivery charges) using your nominated credit card (Visa or Mastercard) , Pay Pal Account or Gift Card account.
8.3 You authorise JB Hi-Fi to debit such amount from your nominated credit card, Pay Pal Account or Gift Card.
8.4 If your nominated credit card is declined by your financial institution, JB Hi-Fi will not be able to guarantee the delivery of the Goods or allow your goods to be collected from store, and may contact you to make alternative payment and delivery arrangements.
8.5 JB Hi-Fi may decide at any time not to accept payment from you by credit card for any reason. If we decline to accept payment, we will not process the Order and may not contact you to inform you that your Order will not be processed. We may process this Order or further Orders if you make a payment by another method that is acceptable to JB Hi-Fi.
9. DELIVERY, RISK AND TITLE IN THE GOODS
9.1 JB Hi-Fi will use its best endeavours to deliver the Goods to your nominated delivery address within the time period specified at the time of placing your Order. However JB Hi-Fi will not be liable to you or anyone else for any losses suffered or incurred due to delay.
9.2 Subject to payment, property and risk in the Goods passes to you upon delivery of the Goods to your nominated delivery address.
10. RETURNS
10.1 Other than in accordance with clause 10, JB Hi-Fi will only accept the return of Goods that have been supplied incorrectly, or vary from their description on the JB Hi-Fi website

11. INTELLECTUAL PROPERTY
11.1 All Intellectual Property in any Material on the Website is the property of JB-Hi-Fi, its advertisers or third party providers. Unless expressly authorised under this Agreement, you may not reproduce adapt, modify, display, perform or distribute any Material or any part of any Material.
12. INDEMNITY
12.1 You waive, release, discharge and relinquish any and all claims that you now have or may have against JB Hi-Fi which are connected with, arise out of, relate to or are incidental to the use of the Website.
12.2 You agree to indemnify JB Hi-Fi and keep us indemnified, and hold harmless from and against any and all claims, loss, damage, taxes, liability and/or expense that may be incurred by JB Hi-Fi arising out of or in connection with the Website by any other person as a result of your, or any person using your passwords:
(a) act or omission;
(b) breach of this Agreement; or
(c) infringement of any Intellectual Property on the Website.
13. LIMITATION OF LIABILITY
13.1 To the extent permitted by law, all conditions or warranties expressed or implied by law are excluded and the liability of JB Hi-Fi (in negligence or otherwise) is limited (at the option of JB Hi-Fi) to the resupply of goods or services, or the cost of having the goods or services supplied again. JB Hi-Fi shall not be liable for any indirect or consequential loss.
13.2 Nothing in these terms and conditions is intended to limit or exclude any liability on JB Hi-Fi’s part where and to the extent that applicable law prohibits such exclusion or limitation.
14. TERMINATION
14.1 JB Hi-Fi may terminate or suspend this Agreement at any time by sending you a notice by e-mail to your nominated e-mail address advising that your Account has been suspended, such termination to be effective the day the notice is received or such later date as specified in the notice.
15. PRIVACY
15.1 JB Hi-Fi's policy on the collection, use and disclosure of customer personal information is set out in its Privacy Statement.
16. GENERAL
Any provision of this Agreement which is void or unenforceable may be severed from this Agreement without affecting the enforceability of other provisions.
A failure or delay by JB Hi-Fi to exercise a power or right under this Agreement does not operate as a waiver of that power or right, and the exercise of a power or right by JB Hi-Fi does not preclude its future exercise or the exercise of any other power or right.
This agreement is governed by and must be construed according to the law of the State of Victoria, Australia and the parties submit to the jurisdiction of the courts in that State.

If your item(s) are all marked 'IN STOCK' at time of ordering, they should leave our warehouse in 1-2 business days. Please then allow for standard Australia Post delivery times from Melbourne. Delays may occur around Christmas, Easter and public holidays.
"Order Now / On Order" Items
If your item is marked "ORDER NOW " at the time of ordering and “ON ORDER” on your confirmation email, it will need to be ordered directly from supplier. Most local suppliers deliver to us within 4 business days. Smaller suppliers can take 1-2 weeks and import items can take up to 12 weeks. Once arrived, we will aim to have your item picked and packed within 1-2 business days. You will receive an email confirmation once it ships. Please then allow for standard Australia Post delivery times from Melbourne. Delays may occur around Christmas, Easter and public holidays.
Multiple Item Orders
Please be aware that we only ship orders when all items on the order are available to dispatch. For example, item A is expected to ship in 2 business days, and item B on the same order usually ships in 10 business days. This order will be shipped when both item A and B are ready to ship, and is estimated to be around 10 business days.
Where there has been a significant delay in supplying outstanding items, we may split orders and dispatch available items at no extra cost.
Consumer Electronic Products
Consumer Electronics (CE) products sold through JB Hifi Online are either sourced from our warehouse in Melbourne or a JB Hifi supplier store, depending on the type of item and its availability. All products are shipped via courier direct to customer unless store pick-up has been requested.
In Stock and Ready to Ship Items
If your item is marked “In Stock and Ready to Ship” at time of ordering, we will aim to have it picked and packed within 60 hours. You will receive an email confirmation once it ships. Please then allow another 2-5 business days for metro courier delivery and 3-7 days for regional areas. Delays may occur around Christmas, Easter and public holidays. Remote deliveries are subject to local transport schedules and may encounter extended delays.
Order Now Items
If your item is marked “Order Now” at the time of ordering, it will need to be ordered directly from supplier or transferred from a JB store. This will take 1- 4 business days. Once arrived, we will aim to have your item picked and packed within 60 hours. You will receive an email confirmation once it ships. Delivery of Large Items
For large screen television deliveries to metropolitan addresses, we utilise point-to-point couriers.
Missed Deliveries
For standard CE items, we will arrange delivery via a national courier network. If the customer is absent at the time of delivery, items will be taken to a local depot or post office. A calling card will be left at the delivery address, containing all relevant contact details.
Remote Locations
Please note that that there are limitations on all courier networks and some remote delivery addresses will not be serviced door-to-door. In these cases, the couriers will deliver to a local depot or Australia Post office and the customer will be contacted to collect from there. Some remote locations such as islands can only be accessed by light aircraft or boat. If an order is too large for a light aircraft we will offer free shipping within metro areas to the customers choice of shipping or barge company. Transport from that point to the destination would need to be arranged by the customer at their own expense. BACKORDERS
CD / DVD / Game Orders
In general, all product on this website is usually available from suppliers within the time indicated with the title details.
From time to time suppliers are not able to supply in the time indicated, and items are placed on backorder. If it appears that your order will not be dispatched on time, you will be informed as soon as possible. You will be offered the opportunity to cancel your order at that time, otherwise your order will be dispatched as soon as the items are available.
Unfortunately, we are not able to provide expected dispatch times for backordered items, though items will be sourced and dispatched as soon as possible. If you have a backordered item and wish to cancel your order, please email us with your order number and cancellation request.
Consumer Electronics Orders
For consumer electronics orders, items are sourced from supplier stores across Australia and availability will be indicated on our website. Sometimes, items may be in-stock in some states but not others and we will indicate this where possible. For out of stock items, they will be back ordered and we will endeavour to give customers an ETA before we finalise their order. Please note that ETAs are based on manufacturer shipping times and can be subject to change.
SPLITTING ORDERS
CD / DVD / Game Orders
We only ship orders when all items on the order are available to dispatch.
For example, item A is expected to ship in 2 business days, and item B on the same order usually ships in 10 business days. This order will be shipped when both item A and B are ready to ship, and is estimated to be around 10 business days.
Customers can choose to split their orders so available stock ships immediately. They will need to send this request via email and extra delivery fees may apply.
Occasionally, JB Hifi may elect to split customer orders to free up warehouse space. Customers will be advised of the split item dispatch via email. In these cases, any extra delivery fees will be covered by JB Hifi.
Consumer Electronics Orders
Consumer electronics orders are only authorised to ship when all items are available. Occasionally where goods are supplied from more than one supplier, the order may be split and shipped separately. In these cases, JB Hifi will cover any extra delivery costs.
Combined CD / DVD / Game and CE Orders
Combined orders will automatically be split into tow or more shipments. CD/DVD/game items will ship via Australia Post from our warehouse and the consumer electronics items will ship via national courier services.
DAMAGED DELIVERIES OR INCORRECT SUPPLY
CD / DVD / Game Titles
The JB Hi-Fi website will rectify any products delivered damaged or faulty, or errors in supply. Please refer to our returns policy for more information.
You must contact us via http://www.jbhifi.com.au/contact-us/ to request a Return Authority before returning product. Once you have a Return Authority, please return any damaged or incorrectly supplied goods in the original packaging. We will authorise return to a Reply Paid address. Please note that any returns received unsolicited will be returned to customer at their cost.
Please include a copy of the invoice or packing slip that accompanied your order. The invoice and packing slip also provide an area where you can indicate why you are returning any goods. If you are unable to provide a copy of the invoice or packing slip, include a note containing your name, address, order number, contact phone number, and reason for return.
You will be notified by email when your return is received. We will repair or replace damaged goods when possible; otherwise we will issue a full refund for the value of the damaged item(s).
Consumer Electronics Products
If CE products are received damaged, faulty or not as advertised, please contact us immediately via the email links on this website. We will evaluate the case and arrange to have your product tested, replaced and exchanged at a JB Hifi store, or via courier pick-up where required. Please contact us for further details. We cannot accept returns for “change of mind” reasons. Also we cannot accept returns for items that have been misused or purchased for use with incompatible products.
Most CE products are covered by a minimum 12 month manufacturer’s warranty. If you have a problem with your product within this period, we will assist with further details for repair/replacement. If an extended warranty has been purchased and there is a problem with the product within this period, please contact JB Hifi’s warranty provider on 1800 621 761.
